Why users believe a precedent was set with the 2022 Reignmakers make-good for PA and CT residents

In early October 2022, Draftkings' players in Pennsylvania received shocking news as their Reignmakers game access was cutoff without notice.

Within a few days, Draftkings announced via their discord channel that all affected customers would receive 20% of their net marketplace spend as a make good, and would also be allowed to sell their holdings at market value without any marketplace fees. This make good was also applied to CT residents who had similarly been affected.

Upon researching the topic further, it quickly became apparent that Draftkings failed entirely to disclose the game play details to the PA Gaming Control Board (as required by state law). This was a troubling revelation for players in all states that had invested heavily in the Reignmakers Collectibles.

Why this matters for users outside PA and CT

While this development only restricted users from two states from participating in Reignmakers at the time, it sent shock waves through the Draftkings community.

However, the introduction of the "make good" element of this initial settlement, for players cut off from the gaming aspect of Draftkings collectible ownership, alleviated the panic for most users.

As a result, many of us continued to invest in the product when we would not have otherwise.

It is for this reason we believe Draftkings set a precedent they should now honor for all users affected by the 2024 game closure: That in the event of the removal of the gaming aspect of Reignmakers, users should receive BOTH a make good for their loss of the time and monetary investment in the game, as well as fair market value compensation for all collectibles at the time the game was shuttered.

Draftkings has failed on both fronts.
